Terms of Service

Last updated: July 12, 2026

These terms are the agreement between you and Melody Monkey for your use of the app. By using Melody Monkey, you agree to them. Please read them — they include an "as-is" disclaimer and a limitation of liability.

1. Acceptance of these terms

By accessing or using Melody Monkey (the "Service"), you agree to be bound by these Terms of Service and by our Privacy Policy. If you do not agree, please do not use the Service.

2. What Melody Monkey is

Melody Monkey is a web app for learning and practicing music, including a fretboard/keyboard visualizer, a chord and scale library, a chord-progression library, a personal music teacher, an audio analyzer, a metronome, and a tuner. Features may change, break, or be removed, and availability is not guaranteed.

3. Eligibility

You must be at least 13 years old to use the Service. If you are under the age of majority where you live, you may use the Service only with the involvement of a parent or guardian.

4. Your account

5. Acceptable use

When using the Service, you agree not to:

We may suspend or terminate accounts that violate these rules.

6. Your content

You keep all rights to the content you create or upload (for example, audio files you submit for analysis or messages you send to your personal music teacher). You grant us a limited license to store and process that content solely to operate and provide the Service to you — for instance, sending your message to our AI provider to generate a response, or processing your audio to return an analysis. You represent that you have the rights necessary to submit any content you provide.

7. Personal music teacher — important disclaimer

The personal music teacher generates responses automatically and may be inaccurate, incomplete, or misleading. It is provided for educational and informational purposes only and is not a substitute for professional instruction or advice. Verify important information before relying on it.

8. Intellectual property

The Service, including its software, design, branding, and the "Melody Monkey" name and logo, is owned by us or our licensors and is protected by intellectual-property laws. Musical data such as chord, scale, and progression information is provided for personal learning and practice. These terms do not grant you any rights in our trademarks or the Service beyond the right to use it as intended.

9. Third-party services

The Service relies on third-party providers (including OpenAI for AI responses, and analytics and hosting providers described in our Privacy Policy). Your use of features powered by these providers may also be subject to their terms, and we are not responsible for their services.

10. No warranty

The Service is provided "as is" and "as available," without warranties of any kind, express or implied, including fitness for a particular purpose, accuracy, or non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or secure. This is especially true given the Service is offered free of charge.

11. Limitation of liability

To the maximum extent permitted by law, Melody Monkey and its operators will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, profits, or goodwill, arising out of or related to your use of (or inability to use) the Service. To the extent liability cannot be excluded, it is limited to the amount you paid us to use the Service in the twelve months before the claim — which, on our free tier, is zero.

12. Termination

You may stop using the Service and delete your account at any time by contacting melodymonkeyemail@gmail.com. We may suspend or terminate access if you violate these terms or to protect the Service and its users. Sections that by their nature should survive termination (such as intellectual property, disclaimers, and limitation of liability) will continue to apply.

13. Changes to the Service and these terms

We are actively developing Melody Monkey and may add, change, or remove features at any time. We may also update these terms; when we make material changes we will update the "Last updated" date above. Your continued use of the Service after changes take effect means you accept the updated terms.

14. Governing law

These terms are governed by the laws of the State of North Carolina, United States, without regard to its conflict-of-law rules. You agree that any dispute arising out of or relating to these terms or the Service will be resolved in the state or federal courts located in Charlotte (Mecklenburg County), North Carolina, unless applicable consumer-protection law entitles you to bring a claim in the courts where you live.
